Strata Titles Act 1985 and the new Strata Titles Act (General) Regulations 2019 come into effect 1 May 2020

As you are aware, the amendments to the Strata Titles Act 1985 and the new Strata Titles Act (General) Regulations 2019 have come into effect as of today, 1 May 2020.

These legislative changes includes a number of amendments to functions undertaken by the WAPC or delegated to local government including:

  • the provision of a new form of tenure, ‘leasehold’ strata which allows for the creation of a lot and issuance of a certificate of title for a specified term (between 20 and 99 years).
  • Formalisation of the termination process of strata and survey-strata subdivisions.
  • Amendments to the processing of some types of subdivision, previously undertaken by Landgate, but now requiring approval by the WAPC.

In response to these amendments, the Form 1A and 1C have been updated.

Additionally the Form 24 and 26 process for built strata has been modified and a new form provided, to enable more information to be provided upfront to decision makers. The Form 15A replaces the Form 24 and the Form 15C is proposed to guide the endorsement process (formerly Form 26).
